What happens if someone's team is over the salary cap as per NHL 2010? Would they be then forced to:
a) waive a player b) institute a trade c) send them to the farm d) other
?

I would imagine anyone over the cap would be forced to somehow get under it by the same means as any other team in real life. Make a trade, waive someone, whatever. Now, the only way I see this really being a problem is if NHL10 has some odd cap numbers versus what the numbers actually are. There's not much you can do about that, except just plain draft such that you have a little bit of a pad there.

@ Joe: I'm thinking when James simulates the season he turns the cap hit off. All of the heavy lifting will be done offline so we don't run into that issue.
Also, should we turn injuries off as well? It makes Gaborik/Havlat etc. more attractive than they should be I guess, but just something to think about.

Injuries should stay on, its a real part of the game.
As for the cap, James seems to be all about numbers so like Fear said, all the heavy lifting will be done offline so that can be turned off.

Yeah, thats not a bad idea, having the actual cap off. Everything on our end will be cap-compliant, so that way we don't get into that issue of "EA says this guy's contract is this much, but its actually this", especially with guys who are later signings, guys going through arbitration, etc. etc.

EA typically has a handful of random, inexplicable contracts so I think turning off the cap (in NHL 2010) would be the easiest thing to do. Like people have said, you will NOT be allowed to have your team break the cap in real life. That's all that matters to me.
I'll probably do what I can to provide cap updates after each round so you can avoid going over it. If you're on the verge, you lose a healthy scratch or two. Seems pretty reasonable to me. I don't THINK we have any Tallons-in-training here, but you never know.
The matter of injuries would come down to this: would you be willing to let the computer auto-sort your roster if a guy goes down? I sure as hell don't want to have to constantly update 30 rosters down the fourth line. Esp. since guys get minor injuries frequently in simulation.

Injuries should stay on, its a real part of the game. I agree with this in principle, but doesn't EA have really random, stupid injuries? I'm probably guilty of going off the version of 10 years ago, but I just remember a lot of stupid stuff where there's a normal hit and suddenly "Zigmund Palffy has a broken leg."
